As of the end of October, 2021, 19 states were in the process of suing the Biden administration over its COVID-19 vaccine mandates. Of those 19 states, Missouri and its Attorney General Schmitt is leading one of the lawsuits. Overall, the suits are claiming that this is an overreach of the executive branch and he has no authority to authorize this mandate. Here is a rundown of the various lawsuits.
Florida And Texas
Florida led the way with Governor DeSantis’ announcement that he was suing the administration over the vaccine mandate. Texas sued individually. Texas Attorney General Paxton delineated by saying,
The federal government does not have the ability to strip individuals of their choice to get a vaccine or not [1].
Missouri And Others
Missouri filed suit with the following states: Alaska, Arkansas, Iowa, Montana, Nebraska, New Hampshire, North Dakota, South Dakota, and Wyoming. Missouri Attorney General Schmitt said if the mandate were enforced,
The workforce and businesses could be decimated, further exacerbating the supply chain and workforce crises [2].
Georgia And Others
Still another lawsuit was filed in Georgia by these states: Georgia, Alabama, Idaho, Kansas, South Carolina, Utah, and West Virginia.
What Is In The Lawsuits
These states claim that the vaccine is unconstitutional, an overreach of federal powers. The suits also state that the mandate violates the 10th amendment, uses federal spending to coerce states, and does not allow for public comment. Meanwhile, On Saturday, November 6, 2021, an appeals court blocked Biden’s vaccine mandate [3]. This is a temporary halt as the case moves forward.
